{"id":5095,"date":"2012-02-21T19:11:23","date_gmt":"2012-02-22T00:11:23","guid":{"rendered":"http:\/\/www.prisonersofthecensus.org\/news\/?p=5095"},"modified":"2012-02-24T14:26:05","modified_gmt":"2012-02-24T19:26:05","slug":"hb13senate","status":"publish","type":"post","link":"https:\/\/www.prisonersofthecensus.org\/news\/2012\/02\/21\/hb13senate\/","title":{"rendered":"Virginia bill against prison-based gerrymandering passes Senate committee"},"content":{"rendered":"<p>This afternoon, the Virginia Senate Privileges and Elections Committee <a href=\"http:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?121+sum+HB13\">unanimously passed<\/a> <a href=\"http:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?121+sum+HB13\">HB 13<\/a>, which would allow more counties to avoid prison-based gerrymandering. I submitted <a href=\"\/\/www.prisonersofthecensus.org\/testimony\/Wagner_SUPPORT_HB13.pdf\">testimony<\/a> in support of the bill this morning.<\/p>\n<p><a href=\"\/\/www.prisonersofthecensus.org\/testimony\/Wagner_SUPPORT_HB13.pdf\"><img loading=\"lazy\" decoding=\"async\" src=\"\/\/www.prisonersofthecensus.org\/testimony\/Wagner_SUPPORT_HB13_250w.png\" width=\"125\" height=\"181\" class=\"reportcover right\" \/><\/a> HB13 fixes a quirk in Virginia law that requires counties with large prisons to engage in prison-based gerrymandering. These counties must use Census Bureau prison counts to draw  county supervisory districts, thereby granting undue influence to the districts that have prisons and diluting the votes of residents in all other supervisory districts in the county.   Prior to 2001, all Virginia counties were required to engage in prison-based gerrymandering; but that year Virginia <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+24.2-304.1\">amended the law<\/a>, giving some counties &#8212; if their total incarcerated population was at least 12% of the total county population &#8212; the option to exclude prison populations for redistricting purposes. Counties with slightly smaller prison populations were still required to use the prison populations to dilute the votes of other county residents. <\/p>\n<p>\nHB 13 would give any county with a <a href=\"\/\/www.prisonersofthecensus.org\/news\/2011\/12\/30\/va-counties\/\">single district that&#8217;s 12% or more incarcerated<\/a> the opportunity to avoid prison-based gerrymandering.\n<\/p>\n<p>\nIn an editorial last month, the <em>Roanoke Times<\/em> editorial board declared that HB 13 <a href=\"\/news\/2012\/01\/06\/roanoke-times\/\">&#8220;would move the commonwealth in the right direction&#8221;<\/a> towards ending prison-based gerrymandering.
